<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">GENEVA (28 April 2023) – The
</span><span lang="EN-GB"><a href="https://www.ohchr.org/en/treaty-bodies/crpd"><span style="font-size:13.0pt;line-height:105%">UN Committee on the Rights of Persons with Disabilities</span></a></span><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">
(CRPD) found that Mexico had not taken the required legislative, administrative and other measures, including reasonable accommodation policies and staff training at tertiary education institutions, to ensure that a woman with intellectual disability has access
to inclusive tertiary education. </span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">The Committee published its
<a href="https://tbinternet.ohchr.org/_layouts/15/treatybodyexternal/Download.aspx?symbolno=CRPD%2FC%2F28%2FD%2F70%2F2019&Lang=en">
Views</a> today after examining the complaint submitted by S.M.G.V., a Mexican national who failed the admission test for a Bachelor of Visual Arts. She claimed that she had not been provided with the necessary and appropriate modifications to allow her to
sit the test on an equal basis with applicants without a disability, which amounted to discrimination.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">“This case is not about lowering admission standards but about appropriate modifications and adjustments in assessing applications from people with disabilities during the admission
process,” said Committee member Markus Schefer, adding, “While it is undisputed that there are preconditions concerning the knowledge and skills needed to gain admission to tertiary education, admission procedures must take into account the specific requirements
of candidates with disabilities.” </span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">S.M.G.V.’s disability stems from brain damage caused by difficulty in breathing and crying at birth. Before the age of six, she was diagnosed with delayed motor, perceptual and
language development, which had interfered with her learning processes. Her parents enrolled her in ordinary private schools, and she had satisfactorily completed primary and secondary education and obtained a certificate of technical vocational studies in
fashion design from the Vocational School of Fashion Design in the State of Morelos, with an average grade of 7.5 out of 10.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">S.M.G.V. applied for the Bachelor of Visual Arts at the Morelense Centre for the Arts in the same state in 2014. She was not admitted to the programme as the admission assessment
and process were designed and conducted for candidates without disabilities.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">The Dean of the Morelense Centre informed S.M.G.V. that there was no budget for admitting people with intellectual disabilities and that the curricula were not designed for people
with disabilities.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">S.M.G.V., therefore, sued the tertiary institution and various authorities, including the Governor and the Ministry of Education of the State of Morelos, alleging that the authorities
had failed to put in place measures and public policies to promote the inclusion of people with disabilities and guarantee their access to tertiary education through inclusive programmes.
</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">After her lawsuits were dismissed by the Mexican courts, she brought her case before the Committee, claiming her rights under the
</span><span lang="EN-GB"><a href="https://www.ohchr.org/en/instruments-mechanisms/instruments/convention-rights-persons-disabilities"><span style="font-size:13.0pt;line-height:105%">Convention on the Rights of Persons with Disabilities</span></a></span><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">
had been violated by Mexico. </span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">Taking into account the information provided by S.M.G.V. and the State party’s response, the Committee considered that Mexico had, on a general level, not ensured the accessibility
of the Bachelor of Visual Arts at the Morelense Centre for the Arts, including the accessibility of entrance examinations, information and communications tools, curricula, educational materials, teaching methods, assessments and language and support services.</span><span lang="EN-GB">

<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">The Committee also considered that, in the specific case, the Morelense Centre for the Arts should have initiated a dialogue with S.M.G.V. to determine what reasonable accommodations
were needed for her to take part in the admission tests common to all candidates, such as granting her extra time and providing her with the support of a specialized professional to ensure that she correctly understood test expectations.

<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">The Committee further found that Mexico had failed to protect S.M.G.V. from stereotypes and prejudices related to her disability in the sphere of education.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">The Committee also noted that the violations in this case are not isolated but, rather, are representative of structural challenges faced by people with intellectual disabilities
in Mexico.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">“States parties must ensure that the right of people with disabilities to education is realised through an inclusive education system at all levels, including preschool, primary,
secondary and tertiary education, vocational training and lifelong learning, and for all students without discrimination,” Schefer said.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="EN-GB" style="font-size:13.0pt;line-height:105%">The Committee recommended that Mexico provide S.M.G.V. with an effective remedy and guarantee her rights to tertiary education by ensuring the accessibility of the admission
process at an educational institution of her choice, including through the provision of reasonable accommodation, if that remains her wish. It also recommended that the State party establish complaints mechanisms for cases of violations of the right to education.</span><o:p></o:p></p>

<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">El Comité publicó hoy su
<a href="https://tbinternet.ohchr.org/_layouts/15/treatybodyexternal/Download.aspx?symbolno=CRPD%2FC%2F28%2FD%2F70%2F2019&Lang=en">
Dictamen</a> tras examinar la queja presentada por S.M.G.V., de nacionalidad mexicana, que no superó las pruebas de admisión a la licenciatura en artes visuales. La autora alegó que no se le habían proporcionado las modificaciones necesarias y apropiadas para
permitirle presentarse a las pruebas en igualdad de condiciones con los solicitantes sin discapacidad, lo que constituía una discriminación.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">"Este caso no se trata de bajar los estándares de admisión, sino de introducir modificaciones y ajustes adecuados en la evaluación de las solicitudes de personas con discapacidad
durante dicho proceso", declaró Markus Schefer, miembro del Comité, y añadió: "Aunque es indiscutible que existen condiciones previas relativas a los conocimientos y aptitudes necesarios para acceder a la educación terciaria, los procedimientos de admisión
deben tener en cuenta los requisitos específicos de los candidatos con discapacidad."</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">La discapacidad de S.M.G.V. es producto de un daño cerebral causado por la dificultad para respirar y llorar al momento de su nacimiento. Antes de cumplir los seis años, se le diagnosticó
una discapacidad en el desarrollo motor, perceptivo y del lenguaje, que había interferido en sus procesos de aprendizaje. Sus padres la inscribieron en escuelas privadas regulares, donde concluyó satisfactoriamente sus estudios de primaria y secundaria y obtuvo
un certificado de estudios técnicos profesionales en diseño de modas de la Escuela Profesional de Diseño de Modas del estado de Morelos, con una calificación promedio de 7,5 sobre 10.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">S.M.G.V. presentó su candidatura para la Licenciatura en Artes Visuales en el Centro Morelense de las Artes del mismo estado en 2014. No fue admitida en el programa porque la evaluación
y el proceso de admisión estaban diseñados y dirigidos a candidatos sin discapacidad.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">El rector del centro morelense informó a S.M.G.V. de que no había presupuesto para admitir a personas con discapacidad intelectual y de que los planes de estudios no estaban diseñados
para personas con discapacidad.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">S.M.G.V., por lo tanto, demandó a la institución de educación superior y a diversas autoridades, incluyendo al Gobernador y a la Secretaría de Educación del Estado de Morelos, alegando
que las autoridades habían omitido establecer medidas y políticas públicas para promover la inclusión de personas con discapacidad y garantizar su acceso a la educación superior a través de programas incluyentes.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">Después de que sus demandas fueran desestimadas por los tribunales mexicanos, la autora llevó su caso ante el Comité, alegando que México había violado sus derechos en virtud de
la </span><span lang="EN-GB"><a href="https://www.ohchr.org/es/instruments-mechanisms/instruments/convention-rights-persons-disabilities"><span lang="ES" style="font-size:13.0pt;line-height:105%">Convención sobre los Derechos de las Personas con Discapacidad</span></a></span><span lang="ES" style="font-size:13.0pt;line-height:105%">.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">Teniendo en cuenta la información proporcionada por S.M.G.V. y la respuesta del Estado Parte, el Comité consideró que México, a nivel general, no garantizó la accesibilidad de la
Licenciatura en Artes Visuales del Centro Morelense de las Artes, incluyendo la accesibilidad de los exámenes de admisión, las herramientas de información y comunicación, los planes de estudio, los materiales educativos, los métodos de enseñanza, y servicios
de evaluación y de apoyo.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">El Comité también consideró que, en el caso concreto, el Centro Morelense de las Artes debió iniciar un diálogo con S.M.G.V. para determinar qué ajustes razonables eran necesarios
para ella que pudiera participar en las pruebas de admisión comunes a todos los candidatos, tales como otorgarle tiempo extra y proporcionarle el apoyo de un profesional especializado para asegurar que comprendiera correctamente las expectativas de la evaluación.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">El Comité consideró además que México no había protegido a S.M.G.V. de los estereotipos y prejuicios relacionados con su discapacidad en el ámbito de la educación.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">El Comité también notó que las violaciones en este caso no son aisladas, sino que son representativas de los desafíos estructurales que enfrentan las personas con discapacidad intelectual
en México.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">"Los Estados Partes deben garantizar que el derecho de las personas con discapacidad a la educación se haga efectivo mediante un sistema educativo inclusivo en todos los niveles,
incluida la educación preescolar, primaria, secundaria y terciaria, la formación profesional y el aprendizaje permanente, y para todos los estudiantes sin discriminación", afirmó Schefer.</span><o:p></o:p></p>
<p class="xmsonormal"><span lang="ES" style="font-size:13.0pt;line-height:105%">El Comité recomendó a México que proporcionara a S.M.G.V. un recurso efectivo y garantizara sus derechos a la educación terciaria asegurando la accesibilidad del proceso de admisión
en una institución educativa de su elección, incluso mediante la realización de ajustes razonables, si ese seguía siendo su deseo. También recomendó que el Estado Parte estableciera mecanismos de denuncia para los casos de violación del derecho a la educación.</span><o:p></o:p></p>
