Dear all,
IDA has the pleasure to share with you that the Permanent Missions of Portugal and Brazil submitted this morning to the approval by the Human Rights Council the Resolution on Mental Health and Human Rights.
The Resolution acknowledges that the Convention on the Rights of Persons with Disabilities laid the foundation for a paradigm shift in mental health and created the momentum for deinstitutionalization and the identification of a model of care based on respect for human rights which, inter alia, addresses the global burden of obstacles in mental health, provides effective mental health and community-based services, which respects the enjoyment of legal capacity on an equal basis with others.
In addition, it calls upon all UN members states to abandon all practices that fail to respect the rights, will and preferences of all persons, on an equal basis, and that lead to power imbalances, stigma and discrimination in mental health settings.
The Resolution also urges States to develop community-based, people-centred services and supports that do not lead to over-medicalization and inappropriate treatments, that fail to respect autonomy, will and preferences of all persons.
Yet, the Resolution fails to include clear mention on the prohibition of forced treatment and confinement, due to almost unanimous resistance from Member States.
The negotiation of this resolution was closely supported by members of the World Network of Users and Survivors of Psychiatry (WNUSP) and TCI Asia - Transforming communities for inclusion of persons with psychosocial disabilities.
Strong language proposal from Australia and Mexico, as well as the support from the Office of the High Commissioner for Human Rights (OHCHR), offices of the Special Rapporteur on the Rights of Persons with Disabilities, on the Right to Health, as well as the WHO.
In its conclusions, the Resolution calls on the OHCHR to organize a one and a half day consultation to discuss all the relevant issues and challenges pertaining to the fulfilment of a human rights perspective to mental health, to the exchange of best practices and to the implementation of technical guidance in this regard, including WHO’s initiatives on mental health and human rights, such as QualityRights; and that the consultation should be fully accessible to persons with disabilities.
The Resolution is open to signature from Member States until early next week.
We will be circulating the outcome document in few weeks, as soon as it is approved by the Council.
